General conditions

Your use (accessing, browsing, buying, etc.) of this site is your legal agreement to the policies, terms and conditions stipulated on this page.

Nirvana® Shop does not sell seeds to anyone that will grow the seeds in a country that it is illegal.

You also agree to comply with all applicable laws and regulations, including exports and re-exports control regulations.

If you do not agree to these terms, do not use this site.

We are Nirvana® shop. You can reach us in any of the following ways.

Shipping terms

Nirvana® cannot be held responsible for anything that may happen to your order while in transit. Although we send our orders by first class mail, there is always a small risk of loss and you should be aware of this before ordering.

Shipping time dependents not only upon our mail service, but also, of course, on your local postal services. For this reason, we can only give you an estimated shipping time based on our general experience.

Germination

Cannabis seeds, like all seeds in nature, are living material and Nirvana® Seeds cannot offer guarantees on germination rates, or promise that every seed in every pack will germinate. Nature does not allow any company to be able to make such an absolute statement, and it would be misleading to customers to try to do so.

Nirvana® Shop can however assure customers that all seed batches are tested, correctly stored and handled while they are in possession of the company. Therefore when the packages are received at their destination, 90 to 100% of the seeds in each pack should germinate when the recommended germination method is used.

In some countries the germination of our seeds is illegal. We expect our customers to comply with the laws of the country the seeds will be delivered to. We strongly discourage our customers to act in conflict of the law by growing cannabis plants from cannabis seeds.

Nirvana® Seeds ships cannabis seeds on the condition that they will NOT be used by customers in conflict with any applicable law, and are sold as souvenir and novelty purposes only.

Refunds and cancellation

Refunds and cancellations are only applicable if the order is still in our office and has not shipped yet. If you wish to cancel a paid order or be refunded, you will need to contact Customer Support as soon as possible. Please note that we charge an administrative fee of €5,- per transaction.

Discount vouchers

• Issued vouchers are valid only at www.nirvanashop.com
• Vouchers are to be used for one-time purchase only (unless categorically mentioned).
• Vouchers are to be used by individual customers unless otherwise stated.
• Voucher codes must be entered at the checkout page.
• Unless otherwise stated, vouchers are not valid in conjunction with other promotions or discounts.
• Nirvana® vouchers are not exchangeable for cash.

Limitation of liability

Nirvana® has tried to make the descriptions (including all pictures) of the products as accurate as possible but you should check the dimensions stated on Nirvana® or contact us for exact sizes, in case of clothing items. Nirvana® will carry out its services with reasonable skill and care but does not give any guarantees in respect of other person’s services.

Nirvana® makes no promise that the use of nirvanashop.com will be uninterrupted or error free.  Our website is provided on an ‘as available’ basis. In the event of technical errors we will do our best to repair them as quickly as possible.

Nirvana® contains links to other websites which are not under our control. These links are provided for you use only and we are not responsible for the availability, quality, content or nature of the other sites on the internet that are owned and operated by third parties (“external sites”) to which Nirvana® links and websites located on or through any external site nor for any transactions involving external sites (including as to ‘cookies’, personal data, confidential information, or purchase of domain names or other services). You should contact the site administrator or webmaster for those external sites if you have any concerns regarding such links, websites or transactions.

These Terms and Conditions shall not limit any rights you may have as a consumer that may not be excluded under applicable law nor shall they exclude or limit Nirvana®’s liability for death or personal injury resulting from its negligence nor any fraudulent representation.

Subject as mentioned, to the maximum extent permitted by law, Nirvana® excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss and Nirvana® shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

•    any incorrect or inaccurate information on Nirvana®,

•    any interruptions to or delays in updating Nirvana®,

•    the infringement by any person of any intellectual property rights of any third party caused by their use of Nirvana® or any product purchased with us,

•    any loss or damage resulting from your use or the inability to use the Nirvana® website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control,

•    any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong,

•    any amount or kind of loss or damage due to viruses or other malicious software that may infect a user’s computer equipment, software, data or other property caused by persons accessing, using or downloading Nirvana®, or from transmissions via emails or attachments received from Nirvana® or its licensees and affiliates.

Nirvana® will not be held responsible for any failure to perform any obligation under these Terms and Conditions if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation internet outages, communications outages, fire, flood, etc.

Nirvana® reserves the right to take any criminal or civil action it deems fit in case of bad use of its website and its content, as well as in case of breach of the Terms and Conditions.

Applicable Law and Jurisdiction

The relationship between the user and the provider shall be governed by the applicable laws in force in The Netherlands. In case of dispute, the parties may submit their differences to the ordinary courts in accordance with the applicable rules on international jurisdiction.

Nirvana® is committed to protecting your privacy and promises only to use information collected about you in accordance with our privacy policy.

Legal Disclaimer

Nirvana® sells cannabis seeds as a collectable genetic preservation souvenir.

We dispatch our products on the condition that they will not be used in conflict with applicable local law. The regulation and enforcement in respect of some of the products we sell differ from country to country. We therefore advise you to make inquiries about the regulations to which you are subject. For this reason, Nirvana® can accept no responsibility for products intercepted or lost in transit, if you place an order for a product to be sent to a country where it is illegal.

We refuse to sell cannabis seeds to anyone we have reason to believe is not going to use for personal use only or to use them in a country where cultivation is a criminal offense.

Drug Policy

Nirvana® does not encourage the use, supply or production of illegal drugs or controlled substances in any way.

We do encourage discussion and research into drug policy, favoring those with a strong harm minimization agenda, and reduced emphasis on criminal justice systems.
